When you are pregnant you are entitled to a year off no matter how long you have been in your job. Not everyone takes 52 weeks off, but some do. You will get paid for some of your time off and this is called Statutory Maternity Pay. How long do you get Statutory Maternity Pay for?
Statutory Maternity Pay is the legal minimum an employer has to pay women who are on maternity leave.
You’re entitled to Statutory Maternity Pay if you:
- you’re an employee not a ‘worker’
- you give your employer the correct notice

To get Statutory Maternity Pay, you’ll need to:
- earn on average at least £120 a week
- give the correct notice
- give proof you’re pregnant
- have worked for your employer continuously for at least 26 weeks continuing into the ‘qualifying week’ – the 15th week before the expected week of childbirth
How long do you get statutory maternity pay for?
Statutory Maternity Pay is paid for up to 39 weeks.
After this, your employer doesn’t have to pay you anything for your time off.
The rates change as time goes on throughout your leave.
For example, you will be paid 90 percent of your average weekly earnings before tax for the first six weeks .
For the next 33 weeks, you’ll be paid either 90 percent of your average weekly earnings or £151.20 (whichever is lower).

And, either you or your partner must have worked for the same employer for 26 weeks by the 15th week before the baby is due and stay with them during Shared Parental Leave.
Statutory Maternity Pay is paid in the same way as your wages.
If you’re paid monthly, you’ll be paid monthly. The same goes for weekly pay.
Tax and National Insurance will be deducted from your Statutory Maternity Pay.
